The Federal High Court in Lagos has issued an interim injunction blocking Ikeja Electric PLC and the Nigerian Electricity Regulatory Commission (NERC) from implementing a controversial tariff hike on “Band A” feeders.
The decision follows an ex-parte application filed by Rida National Plastics Limited, contesting the tariff increase published by Ikeja Electric on April 4, 2024, and May 6, 2024.
Justice Chukwujeku Aneke granted the injunction, citing a violation of Section 51 of the Electricity Act, 2023. The ruling prohibits Ikeja Electric and NERC from enforcing the tariff increase on Rida National Plastics’ electricity supply.
Moreover, the court temporarily restrained the defendants from demanding a balance of N20 million from the plaintiff, as stated in the electricity bill dated May 4, 2024. It also barred them from threatening or disconnecting Rida National Plastics’ electricity supply for non-compliance with the tariff.
The case is adjourned until July 9, 2024, for further proceedings. This decision marks a significant legal victory for Rida National Plastics while posing a setback for Ikeja Electric and NERC.
