A Federal High Court in Lagos has rebuked the Economic and Financial Crimes Commission (EFCC) for unlawfully declaring Margaret Emefiele, wife of former Central Bank Governor Godwin Emefiele, wanted. The court termed the EFCC’s action illegal and in violation of Mrs. Emefiele’s fundamental rights.
In suit number FHC/L/CS/262/2024, Mrs. Emefiele had sued the Commission and its chairman, seeking redress for being listed as a wanted person without a valid court order or charge. She sought the removal of her name and photograph from EFCC’s wanted list on its website and demanded a public apology via national media.
Delivering judgment, Justice D. I. Dipeolu ruled that the EFCC’s publication of Mrs. Emefiele’s name and photograph without complying with legal provisions was a breach of her rights under Nigerian laws and international human rights charters. The court ordered EFCC to immediately withdraw the publication and apologize publicly on its website. Additionally, EFCC was directed to pay Mrs. Emefiele N3 million in damages for the infringement of her rights.
The judgment underscores the importance of due process and adherence to legal standards in law enforcement actions.
