A Federal High Court in Abuja has invalidated the impeachment of Philip Shuaibu as the Deputy Governor of Edo State, ordering his immediate reinstatement.
Justice James Omotosho delivered the judgment on Wednesday, citing failure by the Edo State House of Assembly to adhere to due process in the impeachment process.
Shuaibu, visibly moved, reportedly shed tears of joy upon hearing the court’s decision, as reported by The Nation.
Justice Omotosho determined that the allegations leveled against Shuaibu did not constitute gross misconduct under the law, thereby nullifying the impeachment. The judge further directed the Inspector General of Police to provide necessary security for Shuaibu to resume his duties until the end of his tenure, overturning the appointment of his replacement.
In response, the Edo State House of Assembly has appealed the judgment and filed a stay of execution pending the outcome of the appeal. The Assembly had impeached Shuaibu on April 8, 2024, based on findings from an investigative panel that accused him of perjury and leaking government secrets. The panel, chaired by Justice S.A. Omonua (retd.), concluded its proceedings despite Shuaibu’s non-appearance.
Following the impeachment, Governor Godwin Obaseki appointed Omobayo Marvellous Godwins as the new Deputy Governor to complete the remaining tenure ending on November 11, 2024.
